On July 10th, Governor Murphy signed into law Bill C3192/U4454 the Real Estate Consumer Protection Enhancement Act. This new law, effective August 1st, introduces several key changes that will impact all real estate transactions in New Jersey.
Key Changes to Be Aware of:
Mandatory Non-Exclusive or Exclusive Buyer Representation Agreement
From August 1st, it is required to have a Buyer Representation Agreement in place. This document outlines the responsibilities of your agent, details on how their compensation will be paid, and allows them to legally advocate for you throughout the transaction.
Mandatory Seller’s Property Condition Disclosure
Sellers must now provide a completed and signed Seller's Property Condition Disclosure form. This ensures transparency and provides buyers with essential information about the property.
Designated Agency
The new law permits Designated Agency, allowing the managing Broker to choose an agent within the listing office to represent the buyer. This change aims to enhance the representation and services provided to both buyers and sellers.
Disclosure of Representation at Open Houses
Listing Agents are now required to post a disclosure of representation at Open Houses, clearly stating whom they represent. This ensures clarity and helps buyers understand the representation dynamics during the home-buying process.
*In accordance with the National Association of REALTORS® proposed settlement agreement (effective August 17, 2024), any pre-closing disclosure form that pertains to brokerage representation must include the conspicuous statement that broker commissions are not set by law and are fully negotiable.

The Come on Home Real Estate Podcast is a place to get information on real estate, but I have to confess, I never thought we'd tackle something as specialized as pool inspections. But that's exactly what we did in this episode.
As you know, buying a home is a big decision, and one that should always involve a professional home inspection. This episode featured a guest, Michele DiCorcio, from A to Z Pool Inspections. We got to chat with her about how buying a home with a pool adds another layer of complexity to the inspections.
First, we covered the vital role of an inground pool inspection before closing on a home. We wanted to know what to look for during an inspection. Our pool expert detailed the things we should be aware of.
Then we talked about the maintenance of inground pools. As I said, not my area of expertise. But pool inspections are important year-round, Michele explained. Not just when it comes time to sell the property.

Many people assume that U.S. laws prevent undocumented immigrants from buying homes, but I've personally witnessed this not to be true. There are quite a few undocumented immigrants who are homeowners in the U.S. However, to accomplish this, they must jump through a few extra hoops in the process. They must also fulfill all the same obligations as any other homeowner. In light of this, I ask myself, what is it that truly holds them back from homeownership?
Undocumented immigrants are also not permitted to get loans under the same terms as other homeowners. They have a harder time finding lenders who are willing to give them credit. Because of this, they have a much more difficult time getting mortgages, a significant impediment to owning a home. As for fulfilling the other obligations of homeownership, many are simply unable to afford them. If they do manage to make the purchase, can they afford property taxes, insurance, and other ongoing costs?
Undocumented immigrants are still people. They deserve to have a safe and comfortable place to live, just like everyone else. Let's think about them when we vote on legislation for housing.
*******************************************************************************************************
If you are a non-citizen, you may ask yourself, "How can I buy property in the United States?" You must submit some or all of the following documents to your mortgage lender:
* Social Security Number or ITIN
* At least two years of work history in the same position
* Proof of reserves (proof you have enough cash for a down payment or reserves in case of a major repair).
* Recent bank statements.
* Two years of tax returns with the same ITIN.
* Your credit score.
* Valid foreign passport. If you do not have a valid foreign passport, you may be able to use a U.S. visa or a New Jersey driver's license (for undocumented immigrants).
You may not know, but the process of getting a mortgage can be complex. It can also be frustrating if you don't know what to expect. But if you're ready to get started, I'm here to guide you through the process. Please contact our Mortgage Loan Originator Vince Gutierrez at (856) 371-9424. He's an expert who can help you navigate the complexities of getting a mortgage, and ensure that you are on the right path to achieve your goals.
